These Terms of Service (“Terms”) are the rules for using the Assurion Labs website and buying from us. The website is operated by Assurion Labs (“we,” “us,” or “Assurion Labs”). Please read them before you place an order. By using the site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.
About these Terms
“Assurion Labs,” “we,” “us,” and “our” mean Assurion Labs, the business that operates this website. Business location: United States. “You” means anyone who visits the site, creates an account, or places an order. These Terms work together with our Shipping Policy, Refund & Return Policy, and Medical & Product Disclaimer, which are part of the agreement between us.
You must be at least 18 years old, or the age of majority where you live, to place an order. Our store serves customers in the United States only.
Using the site
You may use the site for lawful, personal shopping and to read our educational content. You agree not to:
- use the site in a way that breaks the law or another person’s rights;
- use bots, scrapers, or other automated tools to collect our content, place bulk orders, or get around purchase limits;
- try to gain unauthorized access to the site, to other people’s accounts, or to our systems, or interfere with how the site works;
- upload harmful code or submit false or misleading information;
- buy products for resale without our written permission. If you are interested in wholesale, contact us through our contact form.
Accounts
You can check out as a guest or create an account. If you create one, give accurate information, keep it up to date, and keep your password private. You are responsible for activity under your account. Tell us promptly through our contact form if you think someone else has used it. We may suspend or close an account that is used in violation of these Terms or that appears to be fraudulent.
Orders, pricing, and payment
When you place an order, you are making an offer to buy. Our order confirmation email means we received your order, not that we have accepted it. We accept your order when it ships. We may decline or cancel an order, or limit quantities, for reasons such as product availability, suspected fraud, or an error in pricing or product information. If we cancel an order after charging you, we will refund the charge.
Prices are in U.S. dollars. Sales tax is added where required, based on your shipping address, and is shown at checkout. Shipping charges are described in our Shipping Policy. You agree to give us a valid payment method and accurate billing information. Card payments are processed by our payment processor, Stripe. We never see or store your full card number.
We work hard to list correct prices and descriptions, but mistakes can happen. If we find an error in an order you placed, we will contact you so you can choose to keep the order at the correct price or cancel it for a full refund.
Promotions and discount codes
From time to time we offer promotions, such as free shipping over a set amount, limited-time sales, and new-customer offers. Each offer has its own terms, including what it applies to, when it ends, and any exclusions, and those terms are shown with the offer. Our current new-customer offer works like this:
- WELCOME15 takes 15% off a first order.
- It can be used once per customer, and only one discount code can be used per order. It cannot be combined with other discount codes.
- It applies to the price of eligible products. It is not valid on gift cards (if we sell them), shipping charges, or taxes.
- We may end or change this offer at any time.
Unless an offer says otherwise: new-customer offers apply to a customer’s first order; codes have no cash value and cannot be applied to past orders; and we may cancel or adjust orders that misuse a promotion, such as by opening several accounts to reuse a first-order offer.
Shipping and returns
Delivery, returns, and refunds are covered in our Shipping Policy and Refund & Return Policy. By placing an order, you agree to those policies. In short, unopened products can be returned within 30 days of delivery, and you can ask us to cancel or change an order before it ships.
Product information and results
We aim to describe products accurately, but formulas, packaging, and labels can change, and images may not match exactly what you receive. The label and packaging on the product you receive are the final source for ingredients, directions, and warnings. Please read them before you use a product.
Our skin care products are cosmetics. What we say about a product is general and refers to how skin looks and feels. It is not medical advice. Individual results vary, and we do not promise any particular result.
It is your responsibility to check that a product is right for you, including checking the ingredients for anything you are allergic or sensitive to. Talk with a qualified healthcare professional if you are pregnant, nursing, taking medication, or have a medical condition. Our guides, quiz suggestions, and product pages are educational. Reviews, messages, and other content you send us
If you submit a review, photo, message, or other content, you confirm that it is yours to share, that it is truthful, and that it does not break the law or anyone’s rights. You keep ownership of it. You give us a non-exclusive, royalty-free permission to display, reproduce, and use it in connection with running and promoting the store. We may remove content at our discretion, for example if it is abusive, misleading, off-topic, or contains health claims or personal information. Reviews reflect the opinions and experiences of the people who write them, not ours.
Intellectual property
The site and its content, including the Assurion Labs name and logo, text, guides, graphics, images, and design, belong to us or our licensors and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, sell, modify, or create derivative works from our content, or use our name or logo, without our written permission. If you believe content on the site infringes your rights, tell us through our contact form and include enough detail for us to find and review it.
Links to other websites
The site may link to websites or services run by other companies. We do not control them and are not responsible for their content, products, or policies. A link is not an endorsement.
Disclaimer of warranties
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available.” We do not make any promises that the site will always be available, secure, or free of errors, and we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We work to keep product information accurate, but we do not warrant that descriptions, labels, images, or other content are complete, current, or error-free.
Limitation of liability
To the fullest extent permitted by law, Assurion Labs and its owners, employees, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the site or our products, even if we were told they were possible. Our total liability for any claim related to the site or an order is limited to the amount you paid us for the products at issue.
Some states do not allow certain limits on liability, so some of the above may not apply to you. Nothing in these Terms limits any right you have under consumer protection laws that cannot be waived.
Indemnification
To the extent permitted by law, you agree to defend and hold Assurion Labs harmless from claims, losses, and expenses, including reasonable legal fees, that arise from your misuse of the site or your violation of these Terms or of another person’s rights.
Governing law
These Terms, and any dispute that arises from them or from your use of the site or our products, are governed by the laws of the state where Assurion Labs is organized and by applicable U.S. federal law, without regard to conflict-of-law rules.
Resolving disputes
If you have a problem, please contact us first through our contact form. Most concerns can be settled quickly and informally. If we cannot settle a dispute informally, it will be handled in the state or federal courts located in the state where Assurion Labs is organized, unless the law gives you the right to bring it somewhere else. Either of us may also use small claims court where the claim qualifies.
Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when the current version took effect. Changes apply to future use of the site and to orders placed after the change. If we make significant changes, we will post a notice on the site.
General
If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a part of these Terms right away, that does not mean we have given it up. These Terms, together with the policies linked above, are the entire agreement between you and us about the site and your purchases. You may not transfer your rights under these Terms without our written permission. You agree that we may send you notices, order messages, and account messages electronically.
